§1. personal data controller
The administrator of the personal data is Profizjocare Sp. z o.o., based at 31 Szybowcowa Street, 204, 54-130 Wrocław, registered in the National Court Register under KRS number: 0001039301, NIP: 8943212381, REGON: 525436024, hereinafter referred to as „Profizjoclinic”.

§2 Scope and purposes of personal data processing
Patients' personal data are processed for the following purposes:
- Provision of medical and physiotherapy services - based on Article 6(1)(b) of the DPA (performance of a contract) and Article 9(2)(h) of the DPA (health care).
- Fulfillment of legal obligations - including, but not limited to, maintaining medical records (Article 6(1)(c) of the DPA).
- To contact the Patient - in matters related to appointments, cancellations or rescheduling (Article 6(1)(b) and (f) of the DPA).
- To issue invoices and keep accounts (Article 6(1)(c) of the DPA).
- To pursue or defend against claims (Article 6(1)(f) RODO - legitimate interest of the administrator).
- Direct marketing of Profizjoclinic services - only with the Patient's consent (Article 6(1)(a) RODO).
§3 Types of data processed
We process the following personal data:
- Name, surname, PESEL, telephone number, e-mail address.
- Residential or mailing address.
- Medical data - including information on medical conditions, contraindications, course of treatment, medical records.
- Data necessary for invoicing and billing.
§4 Patients registering through the ZnanyLekarz.pl platform
In the case of registration through the service FamousLekarz.pl, the administrator of personal data remains the owner of the ZnanyLekarz sp. z o.o. platform based in Warsaw. Profizjoclinic receives only the necessary data to carry out the visit (name, surname, telephone number, e-mail, possibly other data voluntarily provided by the Patient).

§5 Recipients of data
Personal data may be shared:
- Entities supporting Profizjoclinic in the field of IT, accounting, legal services - on the basis of data processing entrustment agreements.
- To authorized public institutions - such as the National Health Service, courts, law enforcement agencies - on the basis of the law.
- To other entities - only with the express consent of the Patient.
§6 Data storage
Personal data will be kept for a period of time:
- Medical records - at least 20 years from the date of the last entry in them (according to the Law on Patient Rights and Patient Ombudsman).
- Data related to billing - for the period required by tax and accounting regulations (minimum 5 years).
- Data processed on the basis of consent - until it is revoked.
§7 Rights of the data subject
Each person is entitled to:
- access to their data and receive a copy of it,
- rectification (correction) of data,
- processing restrictions,
- deletion of data - if there is no legal basis for further processing,
- object to the processing of data,
- transfer of data to another controller,
- revoke consent to processing (if the data is processed on the basis of consent),
- lodge a complaint with the President of the Office for Personal Data Protection.

§8 Voluntariness of providing data
Provision of personal data is voluntary, but necessary for the conclusion and execution of the contract for physiotherapy services. Failure to provide data may prevent you from using Profizjoclinic services.
§9 Automated decision-making
Personal data is not used for automated decision-making, including profiling.

Regulations for the provision of specialized services at Profizjoclinic
§1 Purpose and nature of services
- Profizjocare Ltd. (Profizjoclinic) provides physiotherapy and specialized services aimed at improving the health and well-being of patients.
- All measures taken by the Profizjoclinic team are aimed at the best possible tailoring of therapy to the individual needs of the patient.
- The effectiveness of the therapy depends on the individual predisposition of the Patient and his commitment to the therapeutic process, including compliance with the physiotherapist's recommendations. Profizjoclinic makes every effort to ensure that the Patient experiences an improvement in health as a result of therapy.
- Profizjoclinic makes every effort to improve the patient's health, however, due to the individual predisposition of the body, it cannot guarantee specific therapeutic results. The clinic takes full responsibility for the fact that services are provided in accordance with the art of medicine and applicable medical standards.
§2 Booking and cancellation rules
- A visit may be canceled or postponed no later than 24 hours before its scheduled date (date and time).
- If an appointment is canceled less than 24 hours in advance or not held through the fault of the Patient (e.g. absence without notice), the full fee for the appointment will be charged according to the price list. This is due to the fact that during this time the specialist reserves his time and the appointment is blocked for other Patients.
- Profizjoclinic reserves the right to cancel or postpone an appointment for independent reasons (e.g., illness of a specialist), informing the Patient in advance and proposing a new date.
§3 Treatment packages
- Profizjoclinic offers the opportunity to purchase treatment packages at a lower, promotional price. The purchase of a package is voluntary and is a form of prepayment for a certain number of visits.
- Packages are non-refundable and non-refundable, except when, for reasons beyond the Patient's control (e.g., permanent inability to use the services for health reasons or change of residence), it is impossible to continue using Profizjoclinic services. In such cases, the Patient may request a refund of the unused amount.
- In case of cancellation of the package, the used visits are billed at the regular price in effect on the date of purchase of the package. The difference between the amount paid and the value of the used visits at the regular price will be refunded within 14 working days of the written request.
- At the written request of the Patient, Profizjoclinic may extend the expiration date of the treatment package in justified cases (e.g. illness, trip). The decision to extend the term is made on an individual basis.
- At the written request of the Patient, unused funds from the package may be prescribed to another person designated by the Patient, after prior agreement with Profizjoclinic.
- If a treatment package is purchased remotely or off-premises, a Patient who is a consumer has the right to withdraw from the contract within 14 days of its conclusion, in accordance with the provisions of the Consumer Rights Act of May 30, 2014. In order to exercise the right of withdrawal, the Patient should inform Profizjoclinic in writing (e.g. e-mail: rejestracja@profizjoclinic.pl).
§4 Invoices and payments
- The patient has the right to receive an invoice for the service provided - both on paper and electronically.
- Requests for an invoice should be made no later than the day of service. In accordance with current tax regulations, if an invoice is issued, the receipt is retained by the invoice issuer.
- Payments for services can be made by cash, credit card, BLIK or bank transfer, according to the applicable price list.
§5 Liability
- Profizjoclinic (Profizjocare sp. z o.o.) makes every effort to ensure that the services provided are of the highest quality, however, it is not responsible for the lack of therapeutic effects resulting from the patient's individual predisposition or lack of compliance with the specialist's recommendations.
- The patient is obliged to reliably inform the specialist about his or her medical condition, including contraindications to treatments, which is crucial to the safety and effectiveness of the therapy.
- For physiotherapy treatments, such as shock wave Whether IV laser therapy, TECAR, TENS currents, the Patient is informed of potential side effects and complications, such as temporary discomfort, skin redness, bruising or allergic reactions. Profizjoclinic is not responsible for complications resulting from the Patient's failure to follow pre- and post-operative instructions or concealment of health contraindications (e.g. pregnancy, cancer, blood clotting disorders, use of photosensitive drugs in the case of laser therapy).
- For shockwave treatments in particular, the patient is informed of possible side effects, such as pain at the application site, local redness, hematoma, temporary aggravation of pain or rare cases of tissue damage. Profizjoclinic follows safety procedures, minimizing the risk of complications.
- Profizjoclinic ensures that all treatments are performed by qualified personnel in accordance with current medical and physiotherapy standards, which minimizes the risk of complications, but does not eliminate it completely due to individual reactions of the body.
- Profizjoclinic assumes full responsibility for the actions of its employees in the scope of physiotherapy services provided, in accordance with applicable laws and professional standards. Profizjoclinic's responsibility for achieving a specific therapeutic result is excluded in the following cases:
(a) the Patient's failure to comply with the physiotherapist's written recommendations,
b) the Patient's provision of false or incomplete information about his or her medical condition, contraindications or medications taken,
(c) discontinuation of therapy by the patient before completion of the recommended treatment cycle,
(d) other omissions on the part of the patient.
e) the occurrence of objective medical contraindications that make it impossible to continue therapy.
The above exclusions do not apply to damages resulting from medical malpractice, failure to follow safety procedures or breach of professional duties by Profizjoclinic personnel.
§6 Final provisions
- Using the services of Profizjoclinic is tantamount to acceptance of these regulations.
- The regulations are available on the Profizjoclinic website and at the clinic's reception desk.
- In matters not covered by these regulations, the provisions of the Civil Code and the Law on Consumer Rights shall apply.
- Any disputes arising from the performance of services will be resolved amicably, and in case of disagreement - by the court having jurisdiction over the seat of Profizjocare sp. z o.o.
- Profizjoclinic reserves the right to make changes to these regulations. Amendments come into effect 30 days after they are published on the clinic's website and information about the changes is posted in a prominent place at the reception desk.
- Patients will be further informed of the planned changes:
- via email (if they agreed to be contacted by email),
- At the next visit by handing in a written notice,
-by text message (if they agreed to be contacted by phone).
Continued use of services after the effective date of changes to the regulations implies acceptance of the new provisions.
